In 2023 a new law took effect recognizing the rights of unwed fathers. This amendment to Florida’s “Natural Guardian Laws” is a major milestone in the fight for paternal rights and recognizes the important role fathers play in the lives of their children. Before this law took effect, legal guardianship of a child defaulted to the mother. But with the passage of the amendment, both mother and father – as long as paternity has been established – designates both mother and father as legal guardians of their child
Under the new law, establishing paternity must be done through a court action or through the execution of a notarized voluntary acknowledgement of paternity. When paternity has been established, it gives the father the same rights and responsibilities as the mother. However, issues like child support, timesharing or other child-related concerns must be worked out and agreed upon. At times, disagreements may arise relating to these matters and the court’s intervention may be necessary.
