Florida does not recognize Legal Separation. However couples can live apart and make arrangements privately, on their own, for spousal support, timesharing and child support without filing for divorce. Or they can seek legal assistance. In either case, these contracts are enforced by the court.
There is also no legal requirement for a spouse to support during separation, however, either spouse can petition the court for Temporary Support. There are various factors to consider when requesting Temporary Support:
- Length of the marriage
- Ability of the spouse to pay
- Financial need of the requesting spouse
- Each spouse’s financial resources
- Standard of living during the marriage
There are three types of Temporary Support:
- Temporary Alimony which is designed to maintain the status quo during separation. The amount is based on the ability to pay and need.
- Temporary Child Support if the couple have children. The amount is based on the Florida Child Support Guidelines.
- Temporary Attorney’s Fees to provide financial help if you cannot afford to hire an attorney during the divorce process.
Remember that Florida does not automatically recognize spousal support during separation, so it’s in your best interest to consult with an attorney that has the expertise in this area of family law to petition the court to award temporary support during these difficult and transitional times early in the divorce process.
