An Income Withholding Order, or IWO, is typically used in child support cases and occasionally can be used in alimony cases and requires a court order. Typically, if one party is ordered to pay child support, the court will require an IWO which directs the paying spouse’s employer to deduct the amount of child support from that spouse’s paycheck. The funds are sent directly to the Florida support department and are then forwarded to the recipient spouse. That way a clear record is established for any child support payments that are made.
An IWO is used primarily as a means of ensuring that alimony or child support payments are made and on time. It can also be used when child support or alimony payments are past due (in arrears). Of course, an IWO can’t be used in cases where the paying spouse has their own business; it would only apply in cases where the spouse is a W-2 employee.
