Under Florida law, parents have a legal obligation to financially support their child. 

When divorce occurs, child support is calculated according to state legal guidelines to protect the rights of the child and ensure the continued financial support by both parents.

However, under certain conditions, financial circumstances change and the amount of child support can be modified.  In order to modify child support, you must demonstrate a substantial change in income from the time the divorce settlement was made. Changes such these may be grounds for modifying child support:

  • Substantial decreases or increases in either parent’s income
  • A debilitating medical condition of either parent
  • A child completing or discontinuing daycare
  • The loss of a job
  • Substantial increase in certain expenses, like medical insurance or daycare

Examples of the need for modification by either party would be if the parent receiving child support learns that the other parent’s income has increased by 65%.  On the other hand, if the paying parent can prove that their income has significantly decreased, affecting their ability to pay child support, they may be able to file for a modification.
