Florida no longer recognizes the terms “custody” or “visitation” and recently changed the term to “timesharing”. Timesharing refers to the schedule that designates the time that a child spends with each parent. Creating a timesharing or parenting plan is a critical part of the divorce process because it gives the child a sense of routine, predictability and security.

Timesharing agreements cannot be changed at will by either party. To modify a timesharing plan, the parent needs to show a “substantial or material change in circumstances” and that the change in schedule is in the best interests of the child.  

All timesharing determinations in Florida are based on the best interests of the child and consider the health, safety and well-being of the child. The party seeking the modification must file a petition in court and appear before a judge to determine there has been a substantial change in circumstances warranting a modification of timesharing. Examples of such changes include:

  • One parent is relocating
  • A parent refusing to follow the current plan
  • The child living in a potentially harmful situation
  • A criminal conviction of one parent
  • The unfitness of a parent
  • Changes in the needs of the child (i.e., health, education, extracurricular activities)
  • A job change of a parent that allows them to spend more or less time with the child.
