Temporary alimony and child support can be awarded by the Court in many cases.  We will analyze your needs and your spouse’s ability to pay, prepare the appropriate pleadings and make the necessary arrangements to get you temporary relief as soon as possible.

You and your spouse’s debts need to be equitably distributed.  In a contested divorce, the parties may not agree on which person should assume a debt and/or if the responsibility for the debts should be shared.   ADC is experienced in formulating equitable distribution schedules for the Court.  Also, we partner and work hand-in-hand with accountants and other experts and can refer you to the appropriate expert, if necessary. No matter how small or large your liabilities, ADC will guide you through the process.

It’s difficult to say.  Each case is unique.  There are several factors.  A lot depends on your spouse and whether he or she cooperates with discovery and also how willing you are to negotiate a fair settlement.  The more reasonable everyone is, the quicker the case can move along.  If the case can’t be settled at mediation requiring a court trial, we have no control over the court system.  While the courts are crowded and sometimes overburdened, judges try to settle and close cases on their dockets as expeditiously as possible.  ADC will work to make sure your result is fair, fast and favorable.

It depends.  ADC will determine whether you need to file for relocation in accordance with the Florida Statutes and discuss with you the factors the Court will consider in determining whether or not to grant your request.

You may be able to claim dissipation of marital assets and ask the Court to credit you for the amount of money your spouse spent on his/her affair.

No, there’s no such thing as abandonment in the state of Florida.  In a separation either party is able to move out of the marital home without impacting the divorce case. The parties still have to work out the financial issues surrounding the home, such as the mortgage payments, utilities and other household expenses.

Generally, if a retirement account is established during the marriage, then that account would be considered a marital asset and would be divided equally between the parties.  If the account was established prior to the marriage but contributions were made during the marriage, then that account would be partially non-marital and partially marital.
